Dear 1L, Commas + periods go INSIDE the quotes in legal writing. Hereโs a way to remember: โ๐๐ก๐ ๐ฅ๐ข๐ญ๐ญ๐ฅ๐ ๐ค๐ข๐๐ฌ ๐ฆ๐ฎ๐ฌ๐ญ ๐ฉ๐ฅ๐๐ฒ ๐๐๐๐๐๐ ๐ญ๐ก๐ ๐๐๐ง๐๐.โ
๐ฉณ โLittle kidsโ are short.
Periods and commas [.,] are little kids.
They sit on or below the line.
Theyโre too short for cars to see.
They must play safely INSIDE the fence (the quotes).
Dear Legal Writer, The phrase, โassuming arguendo,โ has become a big, bad NO-NO. Itโs Latin. Itโs legalese. And it makes you go in slow-mo.
โ โAssuming, arguendo, that the case is ripe for review, the plaintiff still lacks standing to bring it.โ
Try โeven ifโ instead.

Dear legal writer, Legal writing is important. As lawyers, we donโt have the luxury of not writing well.
Words are the tools of our trade. We get PAID to wield words to persuade. If WE canโt communicate well, whatโs our value anyway?
Dear Legal Writer, Stop using โwouldโ before your verbs.
The word โwouldโ wreaks special havoc in a complaint.
E.g.
โ โPlaintiff would drive 45 minutes longer for the new role.โ
โ โPlaintiff would contribute $100,000 to the fund.โ
โIf you want sexy work, get good at grunt work.โ

When I supervised associates, I could always tell when one was less than thrilled to receive a project.

In the U.S.:

1: Your reader is busy.
2: Your reader will NOT be reading for pleasure.
3: Your reader WILL be reading to extract information.

Dear 2L, We spoke a lot about IRAC essay exams last year, but itโs been several months. I thought a refresher was due.
Key Reminder: You must do a complete IRAC analysis for every Element of every Claim and Defense or for every Factor in the courtโs applicable test.
Dear Legal Writer, Be careful using โnotโ and โbecauseโ in the same sentence.
Hereโs a classic example:

Hmm. Was she promoted?
Thatโs not clear.
Dear Legal Writer, โIf you can give good directions, you can probably write a good brief.โ
โThatโs one of Bryan Garnerโs famous quotes, and I want you to think about what it means.
I also want you to go back to the pre-iPhone and pre-Mapquest days when Garner said it:
Dear Legal Writer, For the love of God, please stop writing โBy and through undersigned counsel.โ
Nothing requires it.
Your signature block covers it.
Your hackneyed legalese adds nothing.
STOP!
