Dear 1L, The comma goes INSIDE the quotes, OK?

Hereโ€™s how to remember: โ€œ๐“๐ก๐ž ๐ฅ๐ข๐ญ๐ญ๐ฅ๐ž ๐ค๐ข๐๐ฌ ๐ฆ๐ฎ๐ฌ๐ญ ๐ฉ๐ฅ๐š๐ฒ ๐ˆ๐๐’๐ˆ๐ƒ๐„ ๐ญ๐ก๐ž ๐Ÿ๐ž๐ง๐œ๐ž.โ€

๐Ÿฉณ Commas and periods are little kids.
They sit on or BELOW the line.
โ€œLittle kidsโ€ are short.
Theyโ€™re too short for cars to see.
They must play INSIDE of the fence.
They must do that for their safety.

๐Ÿ‘– But semi-colons and question marks?
Exclamation points, too?
Theyโ€™re all big kids.
They sit on or ABOVE the line.
Theyโ€™re tall enough for cars to see.
They can play OUTSIDE the fence.
They donโ€™t need the fence for safety.

Two Important Notes:

1๏ธโƒฃ The comma or period goes inside the quotes EVEN IF it didnโ€™t appear in the original that youโ€™re quoting.

๐Ÿ”ท ๐”ผ๐•ฉ๐•’๐•ž๐•ก๐•๐•– ๐Ÿ™:

Original: โ€œThe complaint lacked sufficient facts to survive summary dismissal, but we granted leave to amend.โ€

You: The court dismissed the complaint because it โ€œlacked sufficient facts,โ€ but the plaintiff was granted leave to amend. โœ…

๐Ÿ‘‰ The comma after โ€œfactsโ€ goes inside the quotes, even though no comma appeared there in the original.

๐Ÿ”ท ๐”ผ๐•ฉ๐•’๐•ž๐•ก๐•๐•– ๐Ÿš:

Original: โ€œWe vacate and remand for further proceedings consistent with this opinion.โ€

You: The court โ€œremand[ed] for further proceedings.โ€ โœ…

๐Ÿ‘‰ The period after โ€œproceedingsโ€ goes inside the quotes, even though no period appeared there in the original.

2๏ธโƒฃ Ending question marks, exclamation points, and semi-colons go outside the quotes if they did not appear in the original. But if they did appear in the original, we put them inside the quotes.

To illustrate:

โ—พ๏ธ Did she ask, โ€œWhat time is it?โ€
โ—พ๏ธ Did she assert, โ€œIโ€™ll leave at 9:00โ€?

Please ask me any questions you might have. These punctuation/quotation rules trip up lots of folks, and they are DIFFERENT outside the US.

Dear Legal Writer, The No. 1 way to cut words without losing substance is to put your verbs into active voice, but most lawyers stop after doing only half the job:

Dear 1L, Beware of this mistake I made when I wrote my very first memo. It has been 33 years, but it STILL bothers me when I think about.
